RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND PUBLICITY RELEASE

READ CAREFULLY—THIS AFFECTS YOUR LEGAL RIGHTS

I agree to the following:

1. I recognize that there are certain significant risks associated with the interactive entertainment activities organized by Game On Gaming Trailers. These risks include, but are not limited to, serious bodily injuries and/or psychological harm caused by involvement in a stressful environment that may require some physical exertion. I understand that Mature and Teen rated titles may be played during the experience and that my child/children may be exposed to this content. I am fully responsible for making all parties (essentially including but not limited to the host parent and Game On Gaming Trailers personnel) aware of any special needs or allergies my child/children may have. The risk of serious injury from participating in Game On Gaming Trailers activities, although minimal, does exist as it does in all play and amusement activities.  I agree to assume full responsibility for any personal injury I may sustain in connection with participation in interactive entertainment activities organized by Game On Gaming Trailers, and I release and discharge Game On Gaming Trailers and its owners, employees, representatives, and agents from any liability for any injuries I may sustain, including injuries caused by the negligence of Game On Gaming Trailers or its employees, representatives, or agents.

2. I agree to indemnify and defend Game On Gaming Trailers and its owners, employees, representative, and agents against all claims, causes of action, damages, judgments, cost, or expenses, including attorney fees and other litigation costs and expenses, which may in any way arise out of my participation in interactive entertainment activities organized by Game On Gaming Trailers, including injuries caused by the negligence of Game On Gaming Trailers or its employees, representatives, or agents.

3. I agree to pay for all damages to the facilities of Game On Gaming Trailers caused by my negligent, reckless, or willful conduct.

4. I agree to observe and obey the behavior policy and all other posted rules and warnings, and to follow any oral instructions or directions given by Game On Gaming Trailers or its employees, representatives or agents. Should I drop off my child or children in my care for a party or related activity, I will inform them not to leave the host site until I, or a designated representative, return to pick them up. I will inform them to follow all rules of participation as indicated by the party host and will trust their judgment or the judgment of my representative in their safe participation. I understand the Game On Gaming Trailers staff does not provide a sitting service and is not responsible for the actions of any participants.

5. Any legal or equitable claim that may arise from my participation in interactive entertainment activities organized by Game On Gaming Trailers shall be resolved under Nevada law with exclusive jurisdiction and venue being in the state and federal courts of the State of Nevada.

6. I agree and acknowledge that I am under no pressure or duress to sign this Release and that I have been given a reasonable opportunity to review it before signing. I further agree and acknowledge that I am free to have my own legal counsel review this Release if I so desire, and that Game On Gaming Trailers has offered to refund any fees I have paid to use its facilities if I choose not to sign this Release.

7. The invalidity or unenforceability of any provision of this Release, whether standing alone or as applied to a particular occurrence or circumstance, shall not affect the validity or enforceability of any other provision of this Release or of any other application of such provision, as the case may be.

8. Any controversy or claim arising out of or relating to this Release, or the breach thereof, shall be settled by arbitration administered by a single arbitration appointed by the American Arbitration Association in accordance with its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator may be entered in the state or federal courts of the State of California or a court that has jurisdiction to enter it.

9. I hereby consent to the recording of statements, photographs, and/or audio or video recordings taken of my child/children/myself at this Game On Gaming Trailers event for advertising, trade and/or publicity purposes, without additional compensation, in all media now known or hereafter discovered, worldwide and on the Internet, without notice, review or approval by Game On Gaming Trailers personnel. All statements, photographs, and/or audio or video recordings taken of “the Minor(s)” or me, by Game On Gaming Trailers, may be used by Game On Gaming Trailers for promotional, commercial or other purposes as determined by Epic Games2Go anywhere in the world in its sole discretion. Neither “the Minor(s)” nor I shall have any right to control the use or publication by Game On Gaming Trailers of the statements, photographs, and/or audio or video recordings. On behalf of “the Minor(s)” and myself, all statements, photographs, and/or audio/video recordings taken of “the Minor(s)”or me by Game On Gaming Trailers or its contractors, shall be the sole property of Game On Gaming Trailers. Neither the Minor nor I shall receive any compensation in connection with use of these statements, photographs, and/or audio or video recordings for promotional, commercial or other purposes. I hereby release, waive and discharge any claims of any kind or nature arising out of or relating to the use of the statements, photographs, and/or audio or video recordings against Game On Gaming Trailers or any person or firm authorized by Game On Gaming Trailers to publish said materials (“Publisher”). Such release, waiver and discharge shall also extend to all affiliated companies, shareholders, directors, officers, employees, agents and assigns of Game On Gaming Trailers and any Publisher. I further agree that Game On Gaming Trailers owns all images and recordings it takes of me, and I waive any and all interest in the images and recordings. The permissions granted hereby shall continue to be in force and effect forever.

The Entertainment Software Rating Board (ESRB) ratings provide concise and objective information about the content in video games and apps so consumers, especially parents, can make informed choices. ESRB ratings have three parts:

   • Content Descriptors indicate content that may have triggered a particular rating and/or may be of interest or concern

   • Interactive Elements highlight interactive or online features of a product, including users' ability to interact with each other, the sharing of users' location with other users, if purchases of digital goods or services are offered, and/or if unrestricted internet access is provided.

Content is generally suitable for all ages. May contain minimal cartoon, fantasy or mild violence and/or infrequent use of mild language.

 "Online Music Not Rated by the ESRB" - Warns that songs that are streamed or downloaded as add-ons for music-based games have not been rated and that their content has not been considered in the ESRB rating assignment.

TERMS & CONDITIONS

Below are the standard provisions set forth by Game On Gaming Trailers.

Reservation Deposit

To secure your event booking, Game On Gaming Trailers requires a non-refundable deposit of 25% of the total event cost at the time of booking. This deposit will be applied toward the total cost of your event.

Party Size

Events booked online are for private, small gatherings (20–25 participants or fewer). Pricing listed does not apply to larger group or public events. If you're planning a larger event, please contact us directly to discuss customized options to ensure an exceptional Game On Gaming Trailers experience.

Additional Fees

Additional travel fees will apply for events located outside the Reno and Sparks, Nevada areas to cover extended travel time. For details, please refer to Pricing on the Book Now page.

Payment Terms

The remaining balance is due no later than 14 days prior to the scheduled event date. Failure to pay the balance by this deadline may result in cancellation of the reservation and forfeiture of the deposit.

Cancellation Policy

Because people often book parties well in advance, Customer recognizes that times reserved are in short supply. If the Customer cancels the event within 14 days of the scheduled event date, the deposit will be forfeited and is non-refundable. Cancellations made more than 14 days in advance of the event date may be eligible for a refund at the discretion of Game On Gaming Trailers, less any applicable processing fees. If Customer is a no show for the event, the full remaining balance of the invoice will be due.

Personal Items

Game On Gaming Trailers is not responsible for any personal items or belongings left behind in the gaming trailer after the conclusion of the event. This includes but is not limited to phones, accessories, and other personal belongings. We kindly request all guests to ensure that they collect their belongings before exiting the trailer. Any items left behind will not be the responsibility of Game On Gaming Trailers. We appreciate your understanding and cooperation in this matter.

Weather Policy

Game On Gaming Trailers will make every reasonable attempt to deliver an event. Forecast of bad weather is not an exception to the cancellation policy. However, if an event is affected by unsafe weather (tornado warnings, high winds, high heat, severe storms, heavy snow, unsafe roads, or flooding), Game On Gaming Trailers reserves the right to reschedule your event. No refund will be issued for this reschedule.

Parking Requirements

For all events, Game On Gaming Trailers requires a minimum of 65 feet (approximately 7 standard parking spaces) of clear, level space to park and operate the game trailer. This space must be free of hazards, foot traffic, and obstructions.

The game trailer may only be parked in one of the following locations:

1. • A public street (with city permit when necessary)

   • An approved parking lot

   • A large, accessible driveway (driveways must be evaluated in advance and approved at the sole discretion of Game On Gaming Trailers)

The trailer cannot be parked in any of the following areas:

1. • On sidewalks

   • On lawns, grass, or other landscaping/foliage

   • Blocking a fire hydrant

   • In front of city-painted curbs (e.g., red, blue, or yellow zones)

   • In a backyard, garage, barn, or other non-designated vehicle areas

Additionally, the designated parking area must be clear and level. The trailer cannot be safely operated on steep or uneven terrain. Game On Gaming Trailers personnel will assess the slope and condition of the proposed parking area in advance of the event. If the surface is determined to be unsuitable, an alternative location must be arranged. If a suitable parking location is not available at the time of the event, we reserve the right to cancel or modify the setup, and the event may proceed in a limited capacity or be subject to cancellation without refund.

To ensure the safety of your property and ours, Game On Gaming Trailers reserves the right to refuse to pull the trailer onto any property that does not meet these requirements or presents a risk of damage.

Delays caused by the need to clear space or relocate vehicles will not extend the scheduled event time. Please ensure the parking area is ready and accessible upon our arrival to avoid disruption.

TERMS OF SERVICE

The Customer acknowledges that by accessing or using the Company’s website, https://www.gameon-mobilegaming.com, they agree to comply with all applicable terms of use, laws, and regulations governing such access. The Customer further agrees to comply with all applicable local laws in connection with such use. If the Customer does not agree to these terms, they shall refrain from accessing or using the website.
